Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, and documents review.

A monitoring inspection was initiated on 12/28/2021 and concluded on 1/28/2022 in response to a self-report received on 12/28/2021 in the area of forbidden action. The director was contacted by telephone and a virtual inspection and interviews were conducted. Staff and child records were reviewed remotely. The inspector was on site on 1/14/2022 from 10:00 am-10:25 am to review video footage with the center?s administration.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-410-1
Description: Based on review of documentation, video footage and interview, the center did not ensure that striking a child was forbidden.

Evidence:
1. The center reported on 12/28/2021 that child #1 (DOE: 11/1/2021) claimed that staff #1 (DOH: 8/11/2021) hit him on the hand with a spoon.
2. Video footage from 12/27/2021 showed child #1 sitting at a table eating. It appeared that Staff #1 struck the child's left hand with a plastic serving spoon. The video did not have audio, but the child stood up quickly holding his hand, mouthed "ow" and left the table.
3. Administration confirmed that they terminated staff #1's employment after reviewing the video and confirming that the teacher struck the child's hand.

Plan of Correction: We were notified of the incident and reviewed the information. We immediately terminated the staff and self reported to the department of social services. Staff are trained on guiding behavior and we will continue to monitor teacher interactions.
