Comments:
An unannounced inspection was conducted October 5, 2023 with a local agency in response to a self-reported incident regarding supervision of children. Based on interviews conducted, video footage observed and documentation reviewed, there was a preponderance of evidence to support violations. Areas of non-compliance are identified on the violation notice. Repeat violations were found and are identified within this report.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to the department within 5 business days from receipt. Please specify how the deficient practice will be or has been corrected. Please do not use staff names; list staff by positions only.

Any plans of correction not received within 5 business days will result in the plans not appearing on the Violation Notice and public website.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on record review, the center did not follow their own policies and procedures that are required by these standards.

Evidence:

1) The center's outdoor play and playground policy states a ?minimum of 2 teachers outside with any number of children.?
2) On September 27, 2023, from approximately 4:11pm ? 4:16pm, Staff 1 was the only staff member outside on the playground with 8 children.

Plan of Correction: Policy and procedures will be implemented with a staff member designated to do outdoor activities along with the classes, to ensure that two staff members are always present when outdoors.

Standard #: 8VAC20-780-80-A
Description: REPEAT VIOLATION

Based on record review, the center did not maintain a written record of daily attendance that documents the arrival and departure of children in care as it occurs.

Evidence:
1) On September 27, 2023, there were 9 children present in the Primary 2 classroom but only 8 children were documented in the attendance record.
2) Staff confirmed the attendance record for the day was not accurate and that Child 2 was not marked present into the classroom.

Plan of Correction: A written record along with the electronic record will be maintained in all classrooms, along with the record of check in-out.

Standard #: 8VAC20-780-210-A-3
Description: Based on record review, the center did not ensure all lead teachers met all the requirements to qualify as a program lead.

Evidence: Staff 2 is the lead teacher of Primary 2 classroom. Staff 2 does not meet any of the options to qualify as a program leader; she has programmatic experience but not the training or education required.

Plan of Correction: We will ensure that ALL of the teachers have the required trainings, and experience by sending them through training that meets or exceeds the requirements for the lead position.

Standard #: 8VAC20-780-340-A
Description: REPEAT VIOLATION

Based on vide footage and interviews, the center did not always ensure the care and protection of children.

Evidence:

1) On September 27, 2023, from approximately 4:11pm until 4:16pm, Staff #1 left Child #1 (3 years) alone and unsupervised on the playground.
2) Staff 1 was not aware Child #1 was missing until another staff person told Staff 1 they were missing a child.
3- Child 1 stated, ?I was crying because no one was helping me.?

Plan of Correction: Staff 1 has been terminated, and no longer works for the facility as of the same day of incident occurrence. Name to face training will be re-distributed.

Standard #: 8VAC20-780-340-F
Description: Based on interviews and observation of video footage, a child under 10 years of age was not always within actual sight and sound supervision.

Evidence:

1) On September 27, 2023, at approximately 4:11pm, Staff 1 and 7 children entered the multipurpose room from the playground. Staff 1 was not aware that Child 1 (3 years) was left alone outside on the playground.
2) Video footage shows Staff 1 and 7 children entering the multipurpose room. Staff 1 counted the children then Staff 1 and 7 children walked out of the multipurpose room to their classroom.
3) When Staff 2 returned to the classroom with a child from the bathroom, Staff 2 counted the children and noticed they did not have 9 children in the classroom. Staff 2 told Staff 1 that a child was missing. Staff 1 and Staff 2 searched the classroom, but the child was not there; they then went outside to look for Child 1.
4) At 4:16pm (approximately 5 minutes after leaving the playground), video footage shows Staff 1 going out to the playground and returning with Child 1 who was out on the playground alone.
5) When interviewed, Child 1 stated ?My teacher left me outside by myself.?

Plan of Correction: Sight, Sound, Supervision Re-training will be required for the entire staff. Along with to name to face training.
