This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A complaint inspection was initiated on 10/12/20 and concluded on 10/28/20. A complaint/self-reported incident was received by the department regarding allegations in the areas of care of the children. The director/provider or in-charge person was contacted by telephone to conduct the investigation. The inspector emailed the director/provider a list of documentation required to complete the investigation. The evidence gathered during the investigation did not support the allegation of non-compliance with standards or law. However there was a violation that was not related to the complaint regarding employee background checks that can be found on the violation notice.
Based on a review of one staff record, it was determined that the provider did not ensure that the center obtain a copy of the results of a criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years.
Evidence: 1. The record for staff #1 (date of hire 8/31/20) did not contain documentation of a completed criminal history record information check and sex offender registry check from the state of New York. The sworn statement or affirmation located in the record for staff #7 indicated that staff #7 lived in the state of New York within the last 5 years. 2. Staff #2 (Administrator) reviewed the record for the staff #1, and confirmed that the criminal history record information check and sex offender registry check from the state of New York had not been received.
Plan of Correction:
The facility responded: The staff had the sex offender registry in the file. We thought that was all that was needed from the state of NY. Going forward we will check the DSS website for background instructions as well as contact our state representative for clarification on the background requirements for out of state backgrounds. The correct background has been ordered as of 10/30.
