Technical Assistance:
Section 22.1-289.011 of the Code Of Virginia requires every person who operates a child day program or family day home to obtain the appropriate license. A program operated in a residence caring for five or more children (exclusive of the provider's child or household member children) must be licensed. Your voluntary registration certificate is not a license and limits your capacity, at any one time, to four children.

Comments:
A renewal inspection was conducted on March 27, 2024 to review voluntary registration requirements. There were five children present, ranging in ages from five months to four years, with one caregiver. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, and medication. A total of five children?s records, one caregiver and one household member record were reviewed. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-850-110-C
Description: Based on observation and interview, provider did not ensure the criteria on the health and safety checklist is met.

Evidence: The following was found during the renewal inspection:
1. Provider was present with 5 children that were currently enrolled. The maximum provider is permitted to have by law is 4 children at any time that are not the provider's child or a household member child.
2. Child #5 (age 3 months) was observed sleeping in a car seat. There was not a crib or playpen available for use. Provider stated the child sleeps in the car seat or on a napping mat on the floor.

Plan of Correction: 1. Provider will talk to parent of part-time child tomorrow and require parent to call prior to bringing child to ensure there is not more than 4 children at any time.
2. A crib will be brought downstairs into the childcare room today and used for infant child.
