8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
A subsidy inspection was conducted on July 3, 2024. The inspection began at 10am and ended at 12:15pm. A religious exempt code compliance inspection was conducted on the same date as the SHSI supplemental inspection; the two inspections combined cover all subsidy health and safety requirements. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-790-630-A
Description: Areas and equipment of the center shall be maintained in a safe and operable condition. The portable speaker in the toddler room is placed on a plastic shelf that is unstable. Children were observed playing very close to the speaker during the time of the inspection. The speaker poses as a tipping and injury hazard to the children in care.

Plan of Correction: The speaker was removed during the time of the inspection and will not be placed on the shelf.

Standard #: 8VAC20-790-640-A
Description: Hazardous substances such as cleaning materials shall be kept in a locked place using a safe locking method that prevents access by children. The infant room had three bottles of disinfectant unlocked and the children?s bathroom had a bottle of air freshener on the counter all with the warning label ?Keep out of reach of children.?

Plan of Correction: During the time of the inspection, the disinfectant bottles and air refreshener were locked. Staff was reminded that all hazardous substances need to be locked.

Standard #: 8VAC20-790-810-C-1
Description: When food is brought from home, the food container shall be clearly labeled in a way that identifies the owner. 9 of the 10 lunch boxes did not label the child?s name on them.

Plan of Correction: The center will have parents label the children?s lunch boxes.
