63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on January 19, 2021 and concluded on January 20, 2021. The director was contacted by telephone to initiate the inspection. There were six children present with five staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed two children's records, five staff records, and one agent's record submitted by the facility to ensure documentation was complete.

The information gathered during inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 22VAC40-185-60-A
Description: Based on review of children records, the center failed to ensure that all required information was in the child's file.

Evidence:
1. Child #2's record was missing an address for one of the emergency contacts.
2. Staff verified that the file was missing an address for one of the emergency contacts.

Plan of Correction: Site manager will speak with the parent immediately and obtain emergency contact address for the child noted.

Standard #: 63.2(17)-1721.1-B-4
Description: Based on review of staff records, the center failed to ensure that all required out of state background checks were completed before the employee began employment.

Evidence:
1. On the sworn disclosure statement the employee indicated they had lived outside of Virginia within the past five years. The sworn disclosure statement was dated 12/21/2020.
2. There was not an out of state criminal history background check completed for the state the employee listed on the sworn disclosure statement.
3. The sex offender background check was dated 01-08-2021. The first day of employment was 01-04-2021.
4. Staff verified that there had not been an out of state criminal history background check completed, the date the sex offender background check was completed and the date the sworn disclosure statement had been signed.

Plan of Correction: Administration will refer to the list that was provided by the Licensing Specialist to ensure that they complete any out-of-state checks that do no link to Virginia's fingerprint check system. There was a misunderstanding this go around as the Office on Youth Director only checked the Central Registry Check form thinking this was an all-inclusive form for both Central Registry and Background check needs. Administration will provide the Licensing Specialist with evidence that the background check has been completed within 10 business days.
