Comments:
An unannounced inspection was initiated and concluded on September 28, 2023 to determine compliance with the requirements for Voluntary Registration. The licensing inspectors were on site from approximately 10:00am until 11:20am. There were nine nonresident children in care ( age range five months to two years of age) with one caregiver present. See violation notice for additional details. The licensing inspectors reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, and medication. The inspectors reviewed nine children?s records, one provider?s record and one household member?s record.

Information gathered during the inspection determines non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice, sign, and return it to me within 5 business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the stand(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 8VAC20-850-100-A
Description: REPEAT VIOLATION
Based on observation and an interview, the provider did not ensure that the total number of children receiving care at any one time does not exceed four, which is the maximum capacity allowed by law (? 22.1- 289.015 of the Code of Virginia) for family day homes that may apply for voluntary registration.

Evidence:
1. Nine nonresident children were present in the family day home during the September 28, 2023 inspection ranging from five months to two years of age.
2. The written attendance indicated six nonresident children were present on September 25, 2023, September 26, 2023, and September 27, 2023.
3. The provider confirmed this information was correct during the inspection.

Standard #: 8VAC20-850-110-C
Description: Based on record review and observation, the provider did not meet the criteria on the health and safety checklist at the time of the monitoring visit.

1. The provider did not practice emergency evacuation drills monthly to the point of exit from the home.
a. The emergency drill document indicated the last practiced emergency evacuation drill occurred on 08/01/2022.
b. The provider confirmed the emergency evacuation drills did not take place monthly and the documented dates on the emergency drill log were accurate.
2. The provider did not ensure safety gates were placed on stairways that were accessible to children.
a. The stairs leading to the second floor was in the children?s play area. Nine children were present in the play area, ranging from six months to two years of age. A safety gate was not placed on the stairway and the stairway was accessible to the children in care.
b. The provider stated the gate for the stairway was broken.
3. The provider did not keep a copy of the physical examination results obtained on each child before or within 30 days after enrollment and medical release form from each family to permit emergency care.
a. The record for Child #9 (first day of attendance 05/08/2023) did not contain the results of a health examination.
b. The records for Child #1 (first day of attendance 04/22/2022) and Child #6 (first day of attendance 01/30/2023) did not contain the parents? signed authorization for the child?s emergency medical treatment.
4. The provider failed to keep toxic household products in areas inaccessible to children.
Two toxic household cleaning products were located sitting on the hallway floor, an area accessible to the children in care.
5. The provider did not ensure her hands and the child?s hands were washed with soap after toileting and diapering.
a. The provider was observed changing the diaper of Child #2 during the inspection.
b. Immediately after the diaper change, the provider and Child #2 began playing in the childcare area. The provider did not wash the hands of Child #2 and her hands while the inspectors were on site.
6. The provider did not adhere to the required point system required to supervise children and determine if an additional caregiver is necessary
a. Nine nonresident children were present during the inspection. The children in care ranged from six months to two years of age for a total of 27 points.
b. Additional providers are required when the total number of points assigned to the children in care is 17 points or more.
c. The provider confirmed this information was accurate during the inspection.
7. The provider did not ensure any adult (18 years of age or older), including any adult household member, who comes in contact with children or provide care to children had a tuberculosis (TB) test or screening within the required timeframes.
a. The record for Provider #1 contained a negative TB test dated 06/15/2020. Updated TB test or screenings are required at least every two years.
b. The record for Adult Household Member #1 did not contain a negative TB test or screening.
