Comments:
A complaint inspection was initiated on 3-7-24 and concluded on 3-7-24. The inspector reviewed compliance in the area of staffing and supervision. The inspection started at 9:30am and concluded at 10:30am.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Complaint related: Yes
Description: Based on review of video the center failed to ensure that supervising staff of children shall always ensure their care, protection, and guidance as required.

Evidence:
On 2/29/24 staff #1 was seen on video sitting in a chair in the area used by the children (gymnasium) while 4 children were fighting, 2 boys and 2 girls. The video showed that the staff member was positioned to see this fight and did not intervene but continued to stay seated. The fight started at approximately 4:51pm and continued until approximately 4:55pm; according to the time on the video.
Staff #1 did not ensure the care, protection, and guidance of these children during this as she did not intervene as required.
The fight was not addressed in any manner until staff #2 returned to the gym and intervened at approximately 4:55pm.

Plan of Correction: Once administration was made aware of this incident a new lead teacher was put in place at this location. Also, administrative staff have been going to this site daily, during hours of operation, to ensure compliance and safety of the children.

Description: Based on review of video the center failed to ensure that children under 10 years of age are always in sight and sound supervision as required.

Evidence:
1. On 2/29/24 staff #1 could not see children who had built a "fort" by using tumble mats that they positioned vertically in a tall standing circle.
Staff #1 was seen on video sitting near the wall across the gym from this and could not see into this fort from her position. She did not get up and go over to the fort to check on the children; and did not provide sight supervision to these children.

2. A little while later, after the vertical "fort" was taken down by the children, another mat fort was built beside staff #1, who was still seated in the same place, which prevented her from seeing a small group of children that were to her right in the corner of the gym. Since she remained seated for the majority of the programs operation, she could not provide the required sight supervision of those children.

Staff #2 was in and out of the gym during these times.
