Comments:
An unannounced complaint inspection was conducted on February 23, 2023 in response to an allegation received by the department on February 22, 2023 regarding behavior guidance, forbidden actions and supervision. The Inspectors were on site from approximately 11:10 am until 1:10 pm. Interviews with staff were conducted, documentation reviewed including staff and children?s records, and observations were made. The preponderance of evidence gathered during the investigation did not support the allegations of non-compliance with standards or law and therefore; the complaint was not valid. Unrelated violations of standards were found during the course of the investigation and are identified on the violation notice. If you have any questions about this inspection, please contact the Licensing Inspector.

Violations:
Standard #: 8VAC20-780-40-E
Complaint related: No
Description: Based on review of documentation and interview, the facility did not ensure that the center?s activities, services, and facilities were maintained in compliance with these standards, the center?s own policies and procedures that are required by the standards, and the terms of the current license issued by the department.

Evidence:

1. The center?s parent handbook and parent contract states, ?This contract may be terminated by either you or Mae?s Learning Academy, by giving a written two week notice in advance. Should Mae?s Learning Academy terminate care: You are responsible for payment for all days your child is scheduled for care during this time, regardless of whether or not your child is actually present.?
2. The record of child #1, contained documentation of a signed contract dated 06/10/2022. Enrollment for child #1 was terminated by Mae?s Learning Academy on February 16, 2023. A written letter notifying the parents of child #1?s termination was dated February 16, 2023 and given to the parents on February 16, 2023. The center did not follow their own policies and procedures and did not afford the family of child #1 two weeks written notice of termination.

Plan of Correction: Per the provider: I am currently working with my mentor on updating the center's policy and procedures. I will make sure my policies cover reasons for immediate termination along with policies for two week notice of termination. I will follow my policies and procedures.
