Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.

Comments:
A monitoring inspection was conducted on 6/10/2024. 9 children (26pts) were present with 2 caregivers. The physical space, evacuation drills, safety supplies, attendance records, caregiver/household member records, 3 child ren's records and required posted documents were reviewed. No medications were on site. Previous violations were brought into compliance. Children were observed washing hands, eating snack, interacting with each other and engaging with the caregivers. Children had been playing outside as the inspection began. Interactions were positive. Age appropriate materials were available throughout.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the Violation Notice issued to the program. For questions regarding this inspection, please contact Stephanie.salvatori@doe.virginia.gov

Violations:
Standard #: 8VAC20-800-70-A
Description: Based on record review, the Provider did not have documentation showing whether or not there is liability insurance of at least $100,000 per occurrence and $300,000 aggregate in force on the family day home operation as required by 22.1-289.050 of the Code of Virginia. Evidence: 1 out of 3 children's files did not contain the Limited Liability Insurance documentation. The documentation was missing for Child A.

Plan of Correction: I will ask for the documentation right away.

Standard #: 8VAC20-800-140-B-1
Description: Based on record review, the Provider did not have documentation to demonstrate a high school program completion or the equivalent or (ii) evidence of having met the requirements for admission to an accredited college or university. Evidence: Caregiver A was missing documentation demonstrating the highest level of education.

Plan of Correction: I will ask for the documentation right away.

Standard #: 8VAC20-800-240-A
Description: Based on observation, an area of the family day home was not operating in a safe and operable condition. Evidence: The edges around the area rug, in the classroom, were frayed and curled up, creating a tripping hazard.
