Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, on-site monitoring inspection was initiated on May 29, 2024 from 11:00 a.m. to 2:00 p.m. The inspector reviewed compliance in the areas listed above. There were 112 children present and 21 staff. The inspector reviewed 10 children?s records and 10 staff records on-site. This inspection included document review, tour of the facility, interviews, and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Out of state background checks shall be conducted as required. Staff 2, Staff 4, and Staff 10 indicated on their sworn disclosure statement s that they had lived outside the state of Virginia within the past five years. There was no documentation to support that two required out of state criminal record checks were conducted prior to employment. There was no documentation that three out of state searches of the child abuse and neglect registry were submitted within 30 days of employment as required.

The surface of the item is sprayed or dipped into the disinfectant solution and allowed to air dry on the surface for a minimum of two minutes or according to the disinfectant solution instructions. A staff person in the infant room cleaned and sanitized the diaper changing table, but did not allow the disinfectant to dry for a period of at least 2 minutes.
