Comments:
An unannounced complaint investigation was conducted on-site on April 29, 2024 and May 14, 2024. The department received a complaint in the area of programs. Observations were made, video footage reviewed, and interviews conducted along with cps and law enforcement.

The evidence gathered during this investigation did not support of the allegation of non-compliance with standards or law. The complaint is not valid. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Description: Based on a review of records, video footage and interview, the center failed to maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.
Evidence: The inspector reviewed attendance with the provider for April 25 and April 26, 2024. Review of the attendance shows there was no documentation of the arrival and departure of child #1 on April 25, 2024 and on April 26, 2024. Video footage showed child #1 in care on April 25, 2024 and April 25, 2024. The provider confirmed child #1 was in care on April 25 and April 26, 2024.

Description: Repeat Violation
Based on observation and interview, the center failed to ensure that hazardous substances were kept in a locked place using a safe locking method that prevents access by children.
Evidence: In the kitchen area there was a bottle of Clorox spray and bottle of Windex on the counter. The labels on each state "keep out of reach of children" and "caution." Staff #2 confirmed the hazardous substances were not kept in a locked place.
