Technical Assistance:
Licensing standards regarding water testing in 2025 were discussed with the director.

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was conducted on June 7, 2024 from 10:10am to 2:45pm. At the time of the inspection there were 19 infants in care and 2 staff members. Children were observed participating in various activities including diapering, meal time, free choice play. Records were reviewed for five children and five staff members. Evacuation drills, emergency supplies and other required records and postings were reviewed. The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice and discussed with the director during the exit interview.

Description: Based on record review and interview it was determined that the center did not ensure to have a criminal history check completed prior to the first day of employment for all staff.
Evidence:
1. Staff #3 did not have a criminal history background check and was observed caring for infant children during the inspection.
2. The director, Staff #1 confirmed that Staff #3 did not have a criminal history background check completed prior to employment and was caring for infant children.

Description: Based on observation and interview, it was determined that the center did not ensure that the center shall maintain and keep at the center a separate record for each child enrolled.

Description: Based on record review and interview, it was determined that the center did not ensure that staff records shall be kept at the center for each staff which includes the name, address, verification of age requirement, job title, and date of employment or volunteering, and name, address, and telephone number of a person to be notified in an emergency.

Description: Based on record review and interview, it was determined that the center did not ensure that staff complete orientation training in prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

Description: Based on record review and interview, it was determined that the center did not ensure that staff shall complete annually a minimum of 16 hours of training appropriate to the age of children in care.

Description: Based on observation and interview, it was determined that the center did not ensure that cleaning and sanitizing materials shall not be located above food, food equipment, utensils or single-service articles and shall be stored in areas physically separate from food.

Description: Based on observation and interview, it was determined that the center did not ensure that during the stated hours of operation, there always shall be on the premises when one or more children are present one staff member who meets the qualifications of a program leader or program director and an immediately available staff member with direct means for communication between the two of them.

1. Staff #2 confirmed she was alone in the center caring for four infants for approximately ten minutes before an additional staff member arrived.

Description: Based on observation and interview, it was determined that the center did not ensure that the staff-to-children ratios was 1 to 4 for children in care ages birth to 16 months.
Evidence:
1. Upon entrance to the infant center, inspectors observed for approximately 20 minutes, that the infant classroom had 19 children from ages nine months to 16 months and two staff, where five would have been required.
2. Staff #1 (Director) confirmed that the staff to child ratio was not 1 to 4 for the children in care ages birth to 16 months and further acknowledged that 3 more staff were needed.

Description: Based on observation and interview, it was determined that the center did not ensure that staff shall provide awake infants not playing on the floor or ground a change in play space at least every 30 minutes or more often as determined by the individual infant's needs.

1. 14 of the 19 infants under 24 months were observed strapped and sitting at an activity table with no activities for approximately 45 minutes.
