Comments:
An unannounced monitoring inspection was conducted to investigate a self-reported incident received by the department related to Supervision, Procedures for Emergencies and Nutrition and Food Services. The inspection was initiated on 11/13/2023 with additional interviews conducted on 11/27/23. Evidence gathered during the inspection from interviews, and documentation review supported the allegation of non-compliance with standards and violations are documented on the violation notice issued to the program and an exit interview was conducted on 12/28/2023. Standard #: 8VAC20-780-40-M
Description: Based on review of documentation, the facility failed to maintain a current written list of children's allergies, sensitivities and dietary restrictions. Evidence: the allergy list in the preschool 1A class was dated: 9/20/2023, and did not include child #1 (start date: 10/2/2023) with a diagnosed food allergy.

Standard #: 8VAC20-780-60-A
Description: (Repeat Violation) Based on review of one child record, not all records contained all required information. Evidence: the record for child #1, with a diagnosed food allergy, did not contain a written care plan that included instructions from a physician regarding the steps to be taken in the event of a suspected or confirmed allergic reaction.

Standard #: 8VAC20-780-340-A
Description: Based on staff interviews, the facility failed to ensure that when staff are supervising children, they shall always ensure their care, protection and guidance. Evidence: Between approximately 12:00-12:30pm on 10/23/2023, after lunch, child #1 began having severe symptoms of an allergic reaction (stomach pain, coughing, vomiting, hives). Staff stated they were not aware that the symptoms child #1 was having were "severe" as per the Food Allergy Research and Education (FARE form) and required immediate intervention such as calling 911 and injecting epinephrine (which was available on site.) Office staff first notified the parents at approximately 12:54pm and then waited an additional 10-15 minutes for the child?s parent to arrive at the center and provide treatment for their child. Parents transported child to the ER where the allergic reaction was confirmed. Staff were unaware of the food eaten that caused the allergic reaction.

Description: Based on interviews, it was determined that the facility failed to follow their own medication procedures as required. Long term prescription drug use and over-the-counter medication may be allowed with written authorization from the child's physician and parent. Evidence: the record for child #1 did not contain written authorization from the child's parent or physician for long term emergency medication that was reported to be on site for child #1 on 10/23/2023.

Description: (Repeat Violation) Based on interviews and a review of documentation, the facility failed to ensure that at least one staff in each classroom has current certification in CPR and first aid. Evidence: Staff # 1 was working alone in the preschool 1A class and does not have documentation of CPR/first aid certification in their record.

Description: Based on multiple interviews, and documentation review, the facility failed to notify parents immediately of any confirmed or suspected allergic reaction. Evidence: on 10/23/2023, between approximately 12:00-12:30pm, child #1 began showing signs of a severe allergic reaction after lunch, and the parents were not notified until 12:54pm.
