Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/.

Comments:
An unannounced code compliance inspection was conducted on 06/26/2024 from 10:20 AM to 11:35 PM. There were 10 children present, ranging in ages from three years to seven years, with two staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and procedures. A total of five children?s records and two staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.031-B-4
Description: Based on record review, the center failed to implement the center's procedure to ensure all children in the center provide immunization records prior to the first day of care.

Evidence:

The records for child1 and 2 (first date of care 1/11/24 for both) did not contain documentation of immunizations.

Plan of Correction: The immunization records for child 1 and 2 will be obtained. In the future no child will be allowed to start until immunization records are obtained.

Standard #: 22.1-289.035-B-2
Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

The records for staff 1 and staff 2, first day of employment 1/11/24 for both, do not have results of fingerprint-based criminal history check.

Plan of Correction: The fingerprint based criminal history check will be completed for staff 1 and staff 2 within 10 days. The results will be sent to the licensing inspector. In the future no staff will be allowed to start working until the results are received.
