Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An announced initial inspection and electronic record review was conducted on 05/28/2024. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, physical plant, special care provisions and emergencies, and background checks. A total of 6 Applicant/Agent records were reviewed. The center was measured to determine the license capacity and the required emergency supplies and policy/procedures were reviewed. The inspector arrived for the inspection at 9:00 am and departed the center at 10:00 am.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.036-A
Description: Based on record review, the center failed to ensure that every applicant for licensure as a child day center shall undergo a background check in accordance with the Code of Virginia prior to issuance of a license and every five years thereafter.

Evidence: The record for Agent/Applicant 2 had a search of the central registry that should have been renewed by 01/22/2024. Agent/Applicant 6 confirmed the updated search of the central registry was not available for review.

Plan of Correction: A request for a search of the central registry was made on 05/16/2024 but has not be received.
