Technical Assistance:
Legislation effective July 1, 2020 reviewed - with emphasis on new out-of-state background check requirements for staff.
Comments:
This inspection was conducted by licensing staff using an alternate protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 12/03/2020 and concluded on 12/11/2020. The director was contacted by telephone to initiate the inspection. There were 47 children present and 7 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 3 staff records and 3 children's records submitted by the facility to ensure documentation was complete.
The information gathered during the inspection determined non-compliance with applicable law and violations were documented on the violation notice issued to the facility.
The licensing inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.
Based on record review and interview the center failed to obtain a copy of the results of a sex offender registry check from any state in which the applicant has resided in the preceding five years. All applicants for employment shall undergo a background check in accordance with subsection B prior to employment.
Evidence: 1. The results of a sex offender check, from the State of Georgia, were not on file for staff 1. a. Staff 1 has a hire date of 11/13/2020 and indicated on her sworn statement or affirmation that she had resided in the State of Georgia within the past 5 years. 2. Administrative staff verified that the results of the sex offender check had not been received for staff 1.
Plan of Correction:
A sex offender check has been obtained and a copy will be forwarded to the inspector. Multiple attempts have been made to obtain this check previously through phone calls to several agencies in the State of Georgia.
