Comments:
A complaint investigation was conducted on October 30, 2019, from 6:15am to 9:00am and on 11/26/2019 from 12:00pm - 1:45pm in response to a complaint received by the Fairfax Licensing Office on 10/22/2019 and on 11/13/2019 regarding allegations of behavioral guidance, staffing and supervision. Staff interviews were conducted, observations were made and staff records were reviewed. Based on the information gathered and documentation provided during the investigation the preponderance of evidence doesn't support the allegation regarding ratios; however, the complaint was deemed valid with regards to behavioral guidance. The complaint related violation is identified on the Violation Notice. Description: Based on staff interviews, behavioral guidance was not constructive in nature, and did not redirect children to appropriate behaviors.

Evidence:
Staff#1 and Staff#2 stated that after being notified about an incident in the Two's classroom during nap time, they reviewed the center's video-camera footage of the classroom recorded on 10/11/2019 and on 10/15/2019. On 10/11/2019 Staff#1 and Staff#2 observed Staff#3 removing Child A (two years old) from their cot, scooping the child into their lap, and patting the child's back. The child was not crying, but the child was observed trying to wiggle themselves out of the staff member's lap. Staff#3 was observed preventing the child from getting away from their lap for approximately 2 minutes. On 10/15/2019, Staff#1 and Staff#2 observed Staff#3 using an inappropriate tone with children, and removing a child from their cot because the child was not going to sleep.

Plan of Correction: All staff were provided clear instruction on the expectations of nap time, including appropriate guidance for redirection, other possible activities for students who do not sleep at nap time and when to call for extra staff support if needed.
