Technical Assistance:
The LI discussed standard 22VAC40-73-580-A with the facility Administrator in regards to annual inspections by the Virginia Department of Health. Due to COVID-19 the facility annual inspection that was due in April 2020 has been postponed until a future date. The LI advised that the facility contact the Health Department to determine their schedule.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A renewal inspection was initiated on 5/21/2020 and concluded on 5/22/2020. The Administrator/Licensee was contacted by telephone to initiate the inspection. The Administrator/Licensee reported that the current census was 27. The inspector emailed the Administrator/Licensee a list of items required to complete the inspection. The inspector reviewed 3 resident records, 3 staff records, staff schedules, fire inspections, health care oversight, dietitian reports, facility menu and special diet list submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-73-260-A
Description: Based on a review of staff records, the facility failed to ensure that each direct care staff member shall maintain current certification in first aid.

EVIDENCE:

1. The record for staff person 1 did not contain documentation of the staff person being certified in first aid. A discussion with staff person 4 expressed that they were unable to locate staff person 1's certifications card during this inspection.

Plan of Correction: The Administrator will locate the first aid training certificate and place in chart.

Standard #: 22VAC40-90-40-C
Description: Based on a review of staff records, the facility failed to ensure that persons required by this chapter to obtain a criminal history record report were not employed by the facility if the report contains convictions of the barrier crimes.

EVIDENCE:

1. The Virginia Criminal Record dated 2/20/2020 in the record for staff person 5, hired on 1/19/2020 has documentation that the employee has been convicted of 2 misdemeanor barrier crimes, 18.2-57 on 4/6/2000 and 18.-.371 3/27/2003. Convictions of more than 1 misdemeanor barrier crime makes this individual ineligible for employment in an Assisted Living facility.

Plan of Correction: The Administrator will notify the staffer and terminate employment.
