Comments:
Licensing Inspector (LI) conducted a complaint investigation in response to a report from a local agency regarding alleged abuse during resident care and inadequate incident reporting. Telephone interviews on 3/18/2020, 3/19/2020 and 3/28/2020 were conducted with resident's family, staff and agency personnel and documentation received by email was review.

While the preponderance of evidence gathered during the investigation did not support all of the allegations included in the complaint, the complaint is deemed valid as violations were found and cited for Standards 70 and Standard 550. Violations and risk ratings discussed with the Executive Director.

Areas of non-compliance are identified on the violation notice. Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return to the licensing office within 10 calendar days.

Please specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. The plan of correction must contain: 1) steps to correct the non-compliance with the standard(s), 2) measures to prevent the non-compliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Description: Based on documentation and interview, facility failed to ensure that facility shall report to the regional licensing office within 24 hours any major incident that has negatively affected or that threatens the life, health, safety, or welfare of any resident.

Evidence: Licensing Inspector received a report from a local agency on 3/5/2020 regarding a reported incident related to resident care that had occurred on 2/7/2020 that negatively affected or threatened the welfare of a resident and the facility had not reported the incident to the regional licensing office.

Description: Based on interviews conducted by telephone, facility failed to ensure that any resident of an assisted living facility has the rights and responsibilities as provided in ? 63.2-1808 of the Code of Virginia and this chapter.and "is treated with courtesy, respect, and consideration as a person of worth, sensitivity, and dignity."

Evidence: Interviews conducted stated that Staff #1's behavior and/or treatment was not always friendly and activities of daily living care performed by several direct care staff was sometimes completed in an abrupt and rushed manner and without respect..
