Comments:

Unannounced complaint inspections were conducted on 6/22/23, 7/25/23, and 8/3/23; in response to complaints received by the licensing office on 5/2/23 and 5/5/23; regarding Staffing and Resident Care and Related Services. The evidence gathered during the investigation supported some, but not all of the allegations; area(s) of non-compliance with standard(s) or law were: 290.A and 1020.A A violation notice was issued; any violation(s) not related to the complaint but identified during the course of the investigation can also be found on the violation notice. The licensee has the opportunity to submit a plan of correction to indicate how the cited violation(s) will be addressed in order to return the facility to compliance and maintain future compliance with applicable standard(s) or law. If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview. Description:	Based on documentation, the facility failed to ensure that there are at least two direct care staff members awake and on duty at all times in each building who shall be responsible for the care and supervision of the residents. Evidence: The facility operates a mixed unit along with a special care unit, and two staff members are required to be awake and on duty for each unit. Two staff members were not awake and on duty at all times in the special care unit of the building on 4/30/23 (11PM ? 7AM shift). On 4/30/23, facility punch reports indicate that Staff #1 began her shift at 11:30 PM. Only one staff member was identified, as being on duty on the special care unit, from 11:07 PM until 11:30 PM. Two staff members were not awake and on duty at all times on the mixed care unit of the building on 5/1/23 (11PM ? 7AM shift). On 5/1/23, facility punch reports indicate that Staff #2 began her shift at 11:27 PM. Only one staff member was identified, as being on duty on the mixed care unit, from 10:55 PM until 11:27 PM.

Description:	Based on documentation, the facility failed to ensure that any absences, substitutions, or other changes are noted on the written work schedule. Evidence: Facility schedules were observed during the inspection. Staff #3 was listed, on the schedule, as working on 4/30/23 from 11PM until 7AM. Facility punch detail reports indicated that Staff #3 used vacation leave on 4/30/23. Staff #4 worked from 11PM until 7AM on 4/30/23, but the change was not noted on the facility?s written schedule.
