Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 03/15/2022. The LI reviewed documentation, toured the facility, and conducted interviews relating to allegations of resident records not being treated confidentially.

The information gathered during the investigation supports the allegation. Based on the preponderance of evidence the complaint is determined to be valid.

Description: 560-F

Based on observation and interviews, the facility failed to ensure that all resident records are treated confidentially.

EVIDENCE:

1. Collateral 1 received an anonymous complaint by telephone on 03/15/2022 reporting that a former employee had access to resident records at the facility during the recent mandated Licensing inspection on 03/15/2022.
2. Interview with staff 1 on 04/19/2022 confirmed the allegation, and staff 1 also indicated the former employee had been asked by staff 2 to assist the facility during the recent Licensing inspection; however, this request had not been authorized by staff 1.

Plan of Correction: An investigation of the allegation was conducted and staff 2 was terminated on 3/25/2022.

Additionally, key staff members are now meeting with the Director of Quality Assurance/Risk Management on a weekly basis. The goal of this meeting is to discuss any items of concern and educate the staff as to the importance of keeping the lines of communication open.
