63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 1/29/2021 and concluded on 1/29/2021. The director was contacted by telephone to initiate the inspection and the inspection was completed virtually using FaceTime. There were 16 children present and 7 staff. The Inspector reviewed 2 children?s records, 2 staff records, and background checks for all agents, submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-1-A
Description: Based on record review and staff interview, the center did not obtain a sworn statement or affirmation and central registry check for one agent.

Evidence:
1. There is no documentation of a sworn statement or affirmation and VA central registry check in the record for Agent #1.
2. Staff stated Agent #1 has been in their position for more than 30 days, but the exact start date was unknown at the time of the inspection.

Plan of Correction: The center sent information and instructions to the Agent regarding forms/checks needed. The center will provide documentation to the Department that the sworn disclosure form was completed and documentation that the central registry check request was sent within 10 business days.

Description: Based on record review and staff interview, the center did not obtain a fingerprint-based criminal background check for one agent.

Evidence:
1. There is no documentation of a fingerprint-based criminal background check in the record for Agent #1.
2. Staff stated Agent #1 has been in their position for more than 30 days, but the exact start date was unknown at the time of the inspection.

Plan of Correction: The center sent information and instructions to the Agent regarding forms/checks needed. The center will provide documentation to the Department that an appointment was scheduled for fingerprinting within 10 business days.
