This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was intiated on October 2, 2020 and concluded on October 9, 2020. A self-reported incident was received by the department regarding allegations in the areas of supervision. The supervisor was contacted by email to conduct the investigation. The inspector emailed the supervisor a list of documentation required to complete the investigation. The evidence gathered during the investigation suppored the self-report of noncompliance with standards or law and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Standard #: 22VAC40-185-340-A Description: Based on a review of documentation and interviews conducted by telephone, the center did not ensure the care, protection and guidance of at least one child in care.
Evidence: On October 1, 2020 at approximately 1:30pm, the following occurred:
1. An independent contractor assisting at the center gave Child #1 (four years old) some of his own personal peanut butter crackers. The independent contractor stated that Child #1 said that he was hungry so he offered and gave the child two of his peanut butter crackers. He indicated that after some time he believes that Child #1 said "his throat [felt] sore".
2. The child's physical examination record and the life-threatening allergy management plan indicated that Child #1 had an allergy and was extremly reactive to nuts and peanuts. Child #1 was administered an epi-pen by center staff and was transported to the hospital by emergency medical services.Plan of Correction: Youth programs and its staff aim to ensure care, protection and guidance for everyone involved in their programs. Immediately following the care of the child, the contractual vendor was removed from the program. As per our policies, all staff are trained in first aid and at least one staff with MAT certification is readily available at all times. Youth programs will continue to follow our policy of "no food sharing". Youth programs will also continue to make the list of known food allergies and dietary restrictions of participants known to all staff. We will also continue to wristband participants daily as an additional indicator of known allergies. Staff continually review these known food allergies and will follow the care plan provided by the child's physician and parent.
