An unannounced investigation was conducted accompanied by local agency representative on December 14, 2021, follow up interviews were conducted on January 21, 2022 and February 4, 2022, in response to a self-reported incident that was received by the licensing office on December 9, 2021; regarding allegations of forbidden actions and inappropriate behavioral guidance. Interviews were conducted and documentation was reviewed. The information gathered during this investigation supports the self-reported allegation of non compliance with standards or law, violations were issued and can be found on the violation notice.

Standard #: 8VAC20-780-40-E Description: Based on staff interviews conducted and review of the center's policies, the program did not ensure that a staff member followed the center's own policies and procedures on discipline and behavioral guidance, including acceptable and unacceptable discipline measures.
Evidence:
1. The center's Behavioral Guidance Plan for Parents states that staff will model and reinforce appropriate behavior, using redirection, verbal interventions and logical consequences. The Behavioral Guidance Plan also states that their discipline does not permit corporal punishment.
2. On 11/30/2021 at approximately 5:30pm, Adult #1 was standing outside the center when they observed (through a window) Staff #1 pushing down Child #1 (2 years old), holding them down on the floor and shaking them.
3. Adult #2 was also standing outside the center and they observed Staff #1 pulling Child #1 roughly, pushing them to the floor, slapping them lightly on the face, then pulling them up and pushing them forward into another child.
4. Based on witnesses' statements, Staff #1 did not follow KinderCare's written Behavioral Guidance Plan.Plan of Correction: Not available online. Contact Inspector for more information.
Standard #: 8VAC20-780-400-B Description: Based on interviews, the center did not ensure that behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and to resolve conflicts.
Evidence:
1. Staff #1 stated that on the day of the incident Child #1 pushed another child, they stated that after the child pushed one of their friends, they talked to the child, and explained to them that it wasn't right to push and they asked the child to give them a hug. Staff #1 stated that Child #1 had no reaction but they stopped the behavior.
2. Adult #1 stated that on 11/30/2021 at approximately 5:30pm, they observed Staff #1 pushing Child #1 (2 years old) to the floor, holding them down and shaking them. Adult #1 was standing outside the center looking through the 2 year old classroom's window during the incident, they stated that prior to the incident they observed Child #1 taking a bin out of one of the shelves and Staff #1 taking the bin away from the child.
3. Adult #2 was also outside the center observing through the window during the incident, they stated that they observed Staff #1 roughly pulling Child #1, pushing them to the floor, slapping them on the face (lightly), then pulling them up and pushing them forward into another child.
4. Based on witnesses statements Staff #1's behavioral guidance was not appropriate to redirect the child's behavior.Plan of Correction: Not available online. Contact Inspector for more information.
Standard #: 8VAC20-780-410-1 Description: Based on interviews, it was determined that a staff member engaged in a forbidden action when they roughly handled a child.
Evidence:
1. Staff #1 stated that on the day of the incident 11/30/2021, the children were looking at pictures in the library area, when they observed Child #1 (2 years old) pushing another child.
The staff member was asked about their reaction to the situation, they stated that they told the child: "this is not right, don't push" and they asked the child to give them a hug.
2. At the time of the incident, two adults were standing outside the center observing the interaction between Staff #1 and Child #1 through a window:
a) Adult #1 stated that they observed Child #1 taking out a bin from one of the shelves and Staff #1 taking the bin away from the child's hands, then Staff #1 proceeded to push the child down, holding them down and shaking them.
b) Adult #2 stated that they observed Staff #1 pulling Child #1 roughly, pushing them to the floor, slapping them lightly on the face, then pulling them up and pushing them forward into another child.
3. Physical punishment, striking a child, roughly handling or shaking a child are forbidden actions.Plan of Correction: Not available online. Contact Inspector for more information.
