8VAC20-780 Staffing and Supervision.

A self reported inspection was initiated on 4/9/2024 and concluded on 5/3/2024. The inspector reviewed compliance in the areas of administration, staffing and supervision. Interviews were conducted with staff and videos were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-340-A Description: Based on interviews and video footage the center failed to ensure when staff are supervising children, they shall always ensure their care protection, and guidance.
Evidence:
On 4/5/24, staff #1 dragged child #1 by the arms into the bathrooms. After washing hands, staff #1 picked child #1 up by the arms and throws the child out of the bathroom. The child landed on their backside.Plan of Correction: Staff will undergo targeted retraining sessions aimed at reinforcing positive guidance techniques and enhancing their abilities to ensure care and protection.
Standard #: 8VAC20-780-340-F Description: Based on video footage, the center failed to ensure that children under 5 years of age was in constant sight and sound supervision.
Evidence:
1. During lunch, staff #1 was in the bathroom for approximately less than one minute. Staff #1 did not have sight supervision of the five children in the classroom.
2. Child #2 hid on the changing table steps during the time the children washed hands and prepared for lunch. Child #2 was out of sight supervision of staff #1 for less than two minutes.Plan of Correction: The center will conduct comprehensive staff retraining focusing on the implementation of appropriate supervision protocols.
Standard #: 8VAC20-780-410-1 Description: Based on interviews and video footage, the center failed to ensure that the following actions are forbidden.
Evidence:
On 4/5/24, staff #1 took a four-year-old child (child #1) by the hand holding her arm up and walking the child on her tiptoes across the room to the bathroom. Child #1 falls to the ground and begins to crawl away from staff #1. Staff #1 grabbed child #1 by the wrist and dragged her into the bathroom. Staff #1 picked up child #1 by the wrist and arm and put the child at the sink. Staff #1 assisted child #1 with handwashing. Staff #1 then picks child #1 up by the arms and throws child #1 out the bathroom door into the classroom area and tosses a blanket on the child. The child landed on her backside. The child began crying. Staff #1 walks over the child lying in the floor. The staff member returns to the bathroom area and sits child #1 on the floor in the bathroom.Plan of Correction: The employee has been suspended pending investigation and subsequently terminated from their position. The incident was promptly reported to licensing.
