During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical Assistance:
Additional enforcement actions will be discussed, regarding repeated background check violations.

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was completed on 09/27/2024, as a part of the licensure period. The on-site inspection began at 10:05 am and ended at 11:30 am. The inspector reviewed compliance in the areas listed above. There were 16 children present and 7 staff. The inspector reviewed 4 children?s records and 3 staff records.

This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 10/02/2024. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 22.1-289-036-E
Description: No person shall be alone with one or more children, without first having completed any required background check.

Staff #3 was alone with 4 children in the Preschool/K Prep classroom, and was not supervised at all times by an individual with all required background checks completed within the last five years.

Plan of Correction: Cleared staff member will be supporting the class.

Standard #: 22.1-289.035-A
Description: The center is required to have employees undergo a repeat background check every five years.

The most recent fingerprint check for staff #2 was overdue by 46 days, and the appointment scheduled to obtain fingerprints was completed 16 days after expiration. Results have not been received and no follow up with the Office of Background Investigation was documented.

Plan of Correction: Moving forward we will make sure all background checks are completed before expiration.

Standard #: 22.1-289.035-B-3
Description: The center must request a search of the central registry prior to the employee's first day of employment. Staff #3 was employed at the center for 26 days before a search of the central registry was requested.

Plan of Correction: All new hires will have checks done before start date.

Standard #: 22.1-289.036-B-2
Description: Centers must obtain a completed national criminal background check prior to the employee's first day of employment.

Staff #3 had been employed for 26 days before the results of the national criminal background check were received.

Plan of Correction: All Staff moving forward will have background checks before start date.
