Unannounced inspections were conducted on these dates in response to a self-reported incident concerning care of children in care.
Based on information gathered through interviews, there is sufficient evidence to support the allegation. A violation will be issued.

Violations:
Standard #: 8VAC20-780-280-H
Description: Based on interviews, the facility failed to ensure that all staff belongings were inaccessible to children in care.
Evidence:
On 6/14/23 at approximately 11:00am, Child #1 (who is 10 years old) reported that they accessed staff #1's key ring which had a small container of pepper spray attached.

Plan of Correction: All staff are required to keep their personal belongings in the their car or locked in the office.

Description: 8VAC20-780-(5)-340-A
Based on information gathered during interviews and a review of documents, the facility failed to ensure care and protection of a child in care.
Evidence:
1. On 6/14/23 at approximately 11:00am in the big room, staff #2 saw child #1 going to the restroom and getting wet paper towels and that the left side of the child's face was red and the eyes were watering. Staff #2 asked child #1 if they knew what was wrong with their eyes. Staff #2 checked the child?s eyes to see if there was something in them. Finding nothing, staff #2 told child #1 to keep putting a cold towel on the eyes and that the child?s eyes would be checked again shortly. Child #1 came to staff #2 a short time later and reported burning around the mouth. Staff #2 asked the child twice what was wrong. After the second question, the child went to get the keys and disclosed to staff #2 what had happened.
Child #1 (who is 10 years old) reported that they accessed staff #1's key ring from a table which had a small container of pepper spray attached. Child #1 reported that they thought the container held hand sanitizer, had sprayed it and had been sprayed in the face.
Staff #1 reported that the keys were inside backpack which was on the floor behind the staff table.
Staff #2 reported that child #1 sprayed the pepper spray on staff #1's water bottle. Child #1 then tried to wipe off the pepper spray with a jacket.

Plan of Correction: All staff are required to keep their personal belongings either locked in their car or locked in the office.
Staff did review policies of ensuring all youth are accounted for and not left alone at any time.
Staff #1 was given a written warning and put on a probationary period.
