22VAC40-185 STAFFING AND SUPERVISION.

The Licensing Inspector conducted an inspection in response to a self reported incident that was received by the licensing office on 2/12/2020. Interviews were conducted with staff relating to allegations that staff members did not supervise a child at all times. The preponderance of the evidence gathered during this inspection supports the allegations. A violation notice was completed. Please complete the Plan of Correction and date to be corrected for each violation cited and return to the licensing off within five business days. Standard #: 22VAC40-185-340-A Description: Based on interviews the center failed to ensure that staff shall always ensure care, protection and guidance.
Evidence:
1. Staff # 1, 2 and 3 stated that child # 1, three years old, was outside on the playground for approximately one to five minutes unsupervised.Plan of Correction: Associate Director immediately reviewed sight and sound supervision procedures for exiting playground and returning to classroom with Site Supervisor and Education Coordinator and provided instruction to develop playground plan for classroom #1. Site Supervisor and Education Coordinator convened classroom # 1 staff to draft playground plan. (2/13/2020)

* Playground Plan will be monitored daily be Education Coordinator or Site Supervisor for two weeks. (2/28/20-3/13/2020)

Classroom #1 staff completed refresher training in Active Supervision that included a question answer test (quiz), and a second refresher training in playground safety. (2/18/2020)
Education Coordinators will update child supervision procedures with an emphasis on playground safety and and develop process list to include steps to ensure active supervision during exiting playground and returning to the classroom. (3/13/2020)
Updated procedures and process will be shared with all center-based staff upon completion and reviewed at their monthly staff meeting. (3/13/2020-3/31/2020)
Staff #1, 2 and 3 will receive a written reprimand addressing failure to perform required functions of their positions: care and safety of children and sight and sound supervision of children. The reprimand will include expectations and guidance for future job performance. The site supervisor will monitor staff performance as noted above in relation to this disciplinary action. A copy of the written reprimand will be placed in each staff member's personnel file. (2/28/20-Staff 2 and 3, Week of 3/2 - Staff 1)
Standard #: 22VAC40-185-340-F Description: Based on interviews the center failed to ensure that children under 10 years of age are always within actual sight and sound supervision of staff.
Evidence:
1. On February 12, 2020, Staff # 1, 2, and 3 were outside on the playground with 14 children. At approximately 10:45 am staff #1 began lining up the children to go inside.
2. Staff # 3 reported that he was encouraging a child to line up. Staff # 1 stated that she counted 14 children and they proceeded to enter the building.
3. Staff # 1 stood at the classroom door counting children as they entered, during this time a child fell and needed assistance getting up. Staff # 1 assisted this child as staff # 2 and 3 came into the classroom.
4. Staff # 1 told staff # 2 & 3 that a child was missing, she went out the classroom door and could see child #1, three year old, standing on the playground looking through the glass door. Staff # 1 stated that, "she ran to the door and accompanied child #1 back to the classroom".
5.
