22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Health Inspections - In collaboration with the Virginia Department of Health (VDH), the VDOE is reminding providers that the Food Establishment Health form is only used by VDH when determining compliance with food regulations. A Report of Environmental Sanitation Inspection form should be used for environmental health inspections and determining compliance with non-food related health requirements such as water supply and sewage disposal. The Report of Environmental Sanitation Inspection form can be found on the Department?s website.

An unannounced, on-site monitoring inspection was initiated on September 16, 2024 and completed on September 16, 2024, as a part of licensure period. The on-site inspection began at 10:50 am and ended at 1:10 pm. The inspector reviewed compliance in the areas listed above. There were 28 children present and 8 staff. The inspector reviewed 5 children?s records and 5 staff records on-site. This inspection included document review, tour of the facility, interviews and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Standard #: 22.1-289.035-B-4 Description: (Repeat Violation) Based on review, facility did not ensure out of state background checks are completed when a staff member has lived outside the state of Virginia within the past 5 years.
Evidence: The record for staff #4 (start date 8/8/2024) did not have documentation of completing out of state central registry and sex offender search for the state noted on the sworn statement or affirmation.Plan of Correction: Staff will go online to have out of state background checks submitted today.
Standard #: 8VAC20-780-260-B Description: Based on review, facility did not ensure there is an annual approval from the health department.
Evidence: The most recent health inspection report available for review was dated 5/17/2023 which is more than a year old.Plan of Correction: Staff will request a health inspection be conducted today.
