Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the
Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/. Standard #: 8VAC20-780-330-B
Description: Based on measurements and observations, the center did not ensure that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles. Fall zones are defined as the area underneath and surrounding equipment that requires a resilient surface. A fall zone shall encompass sufficient area to include the child's trajectory in the event of a fall while the equipment is in use. Falls zones shall not include barriers for resilient surfacing.

Evidence: The playground had a spring rocker (zebra) and a spring rocker (tricycle) and both did not have the minimum of 6 feet of fall zone around the equipment . There was 3 feet 4 inches between the spring rocker (zebra) and a plastic caterpillar and on the other side there was 5 feet between the spring rocker (zebra) and the spring rocker (tricycle).

Plan of Correction: The director will ensure the play ground equipment is removed to maintain 6ft special requirement is met. Children will not be allowed access to equipment until proper spacing is complete.
