Comments:

An unannounced monitoring inspection was conducted on-site December 12, 2023. The director was available during the inspection. There were 43 children present with 9 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 5 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #:	22.1-289.035-B-4
Description:	Repeat Violation Systemic Violation Based on a review of staff records and interview, the center failed to obtain the results of an out-of-state search of the sex offender registry and criminal history check prior to employment and did not request an out-of-state search of the child abuse and neglect registry or equivalent by the end of the 30th day of employment for each employee who has resided in any other state in the preceding five years. Evidence: 1. The record of staff #3, hired 12/11/2023, did not contain documentation of an out-of-state sex offender registry check. Staff #3 indicated on the staff's sworn statement of living out-of-state in the previous five years. Staff #6 confirmed the sex offender check was not complete. 2. The records of staff #4, hired 08/15/2023, and staff #6, hired 08/22/2023, did not contain documentation of a criminal history check, sex offender registry check or the child abuse and neglect registry. Staff #4 and staff #5 both indicated on their sworn statements of having lived out-of-state in the previous five years. Staff #6 confirmed the background checks were not completed.
Plan of Correction:	Sex offender searches have been completed on both Staff #3 and Staff #4. Out of state Central registry requests have been sent for Staff #3 & #4, and we have resubmitted the Central registry for Staff #5 as we were advised that there had been an error with the first submission when we followed up.
Standard #:	8VAC20-780-160-A
Description:	Repeat VIolation Based on a review of staff records and interview, the center failed to ensure that staff submit documentation of a negative tuberculosis screening at the time of employment and prior to coming into contact with children. Evidence: The record of staff #3, hired 12/11/2023, did not contain documentation of a tuberculosis screening. Staff #6 confirmed staff #3 did not have a tuberculosis screening and has been in contact with children.
Plan of Correction:	Tuberculosis test has been filed.
Standard #:	8VAC20-780-70
Description:	Repeat Violation Based on a review of staff records and interview, the center failed to ensure that each staff record contains all the required information. Evidence: 1. The record of staff #3 did not contain documentation of the date of employment in the record and contained documentation of only one reference when two are required. 2. The record of staff #4, hired 08/15/23, did not contain documentation of references. 3. Staff #6 confirmed the date of employment and references were not in the records.
Plan of Correction:	We have contacted the 2nd reference for Staff#3 to request resubmission of recommendation. We will revise our documentation procedure for hiring dates. Recommendations for Staff #4 were retrieved and submitted.
