22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring was conducted on June 26, 2024 from 10:30 a.m. to 1:30 p.m. The inspector reviewed compliance in the areas listed above. There were 102 children present and 18 staff. The inspector reviewed 9 children?s records and 9 staff records on-site. This inspection included document review, tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Out of state background checks shall be conducted as required. Staff 3, (date of employment 4/24/2024) indicated on their sworn disclosure statement that they had lived outside the state of Virginia within the past five years. There was no documentation to support that that the out of state search of the child abuse and neglect registry were submitted within 30 days of employment as required.

Plan of Correction: Out of state background checks will be conducted as required.

Standard #: 8VAC20-780-160-A
Description: Documentation of a negative tuberculosis (TB) screening must be submitted at the time of employment, before coming into contact with children, and shall have been completed within the last 30 days of the date of employment. Staff 1 (date of employment 8/29/2023) had a TB test/screening dated 9/18/2023.

Plan of Correction: Staff will get a TB screening prior to employment.

Standard #: 8VAC20-780-160-C
Description: A tuberculosis (TB) screening is required every two years from the last screening. Staff 6's test/screening was dated 10/05/2021.

Plan of Correction: Staff will get an updated TB test or screening.

Standard #: 8VAC20-780-70
Description: Two references (not related by blood or marriage), as to character, reputation, and competence, shall be checked prior to employment. Staff 3 had one reference related by marriage.

Plan of Correction: References will not be related b blood or marriage.
