Comments:
An unannounced inspection was conducted in response to a self-reported concern regarding forbidden action that occurred at the center on Tuesday, January 28, 2020. The department was notified of the incident on Wednesday, January 29, 2020. The inspection was initiated on Tuesday, February 4, 2020 from 3:10 PM to 4:50 PM. The inspection concluded on Monday, February 10, 2020. This was a joint inspection with one local agency. Interviews with staff were completed and documentation was reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22VAC40-185-410-1
Description: Based on interviews with staff and documentation reviewed, the center failed to ensure that staff does not roughly handle children.

Evidence:
1. Staff #1 took child #1 by the arm to transition child #1 to a different activity due to inappropriate behavior. During the transition to the table child #1 was lagging behind, dropping his body to the floor, as the teacher held his arm and continued to walk with child #1 to the table. Staff #2 picked up child #1 up from the table as a form of redirection for inappropriate behavior. Staff #2 put child #1 down on the floor and escorted child #1 outside the classroom to take a walk. Child #1 began dropping to the floor as staff #1 took him out of the classroom for a walk.
2. Based on Skipwith Academy?s Home office observations of the video footage from the classroom cameras, staff#2 was observed holding child #1?s hand and child #1 is trying to pull away and he grabs at his arm.
3. Child #1 had a dislocated elbow and a fracture to his arm.
