Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced monitoring inspection was started in the center on June 4, 2024 from 10:25 AM until 1:40 PM and concluded on June 4, 2024. At the time of entrance, 74 children were in care with 13 staff members supervising. The sample size consisted of 7 children?s records and 7 staff records. Children were observed playing outside, preparing for and eating lunch and during rest period.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-40-M
Description: Based on observation and staff interviews, the licensee did not ensure the center shall maintain, in a way that is accessible to all staff who work with children, a current written list of all children's allergies, sensitivities, and dietary restrictions. This list shall be dated and kept confidential in each room or area where children are present.

Evidence: The allergy list did not include the shellfish/shrimp allergy for Child #2.

Standard #: 8VAC20-780-80-A
Description: Repeat
Based on documentation review and provider interview the licensee did not ensure that for each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

Evidence: The Ladders 1 room had 18 children in care and only 16 on the attendance list and the Ladders 2 room had 10 children in care and 12 on the attendance list.

Standard #: 8VAC20-780-280-B
Description: Based on observation and staff interviews, the licensee did not ensure hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence: the center?s kitchen was observed unlocked and there were containers of disinfectant, bleach and cleaning products observed on a shelf above the sink. These items are hazardous chemicals, and they were labeled "keep out of reach of children" and at least one other statement "caution", "flammable" and "warning".
