Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced inspection was initiated on August 8, 2024, and completed on 08/16/2024 in response to a complaint received by the licensing office on August 8, 2024, relating to allegations of the prevention of spread of disease. The inspector reviewed compliance in the areas listed above. There were 40 children present and 10 staff. This inspection included document review, tour of the facility, interviews, and observations. The preponderance of evidence gathered during the investigation does not support the allegation(s); therefore, the complaint is determined to be not valid. Though not a part of the original complaint, violations that were not reported were found related to Report Documentation and is documented on the violation notice issued to the program.

Description: The center shall inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention. On August 2, 2024, Child #1 (6 months old) obtained an injury while under the supervision of the center and was taken via ambulance to the hospital. The center did not inform the Department of Education of the incident that required outside medical attention of a child in care.

Plan of Correction: Moving forward, staff will ensure that documentation will be provided to the Department's representative within 2 business days.
