During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical Assistance:
Technical assistance was provided and standards reviewed in the following areas: background check protocol (as of July, 1, 2024), potable water testing requirements, 8VAC20-780-270. Building maintenance, 8VAC20-780-280. Hazardous substances and other harmful agents and 8VAC20-780-550. Procedures for emergencies.

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated and completed on September 19, 2024. The on-site inspection began at 10:50am and ended at 1:45pm. The inspector reviewed compliance in the areas listed above. There were 38 children present and 11 staff. The inspector reviewed four children?s records and four staff records on-site. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 10/7/24. A POC submitted after this date will not appear on the public website.

Standard #: 22.1-289.035-B-1
Description: The center is required to obtain a completed sworn statement prior to the employee's first day of employment.
The sworn statement for Staff #2, currently employed, was dated four weeks after their first day of employment.

Description: Providers must obtain a completed national criminal background check prior to the employee's first day of employment.

Staff #3, who had been employed for less than a week, did not have a completed national criminal background check.

Standard #: 8VAC20-780-80-A
Description: For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

One of eight children was not signed in on the daily attendance sheet on the day of the inspection. The child was in care at the time of the inspection.

Description: Program directors shall be at least 21 years of age and shall meet one of the program director qualification requirements.

There was no record available for review for Staff #1 (program director) to show that they meet the qualifications of program director. The program director was observed working on the day of the inspection.

Description: Hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.

In the infant classroom, there was bleach, dish soap, and detergent left unlocked in a low cabinet with manufacturer?s labels that stated, ?Keep Out of Reach of Children.?

Description: Where playground equipment is provided, resilient surfacing shall comply with minimum safety standards.

The outdoor play area of the center had less than two inches of resilient surfacing, which is less than the required six inches.

Description: Staff-to-children ratios are required whenever children are in care.

The required ratio for the toddler aged classroom is 1:5; however, there was only teacher with six children for approximately 10 minutes.
