A complaint was received involving care, protection, guidance and sight and sound supervision. The complaint investigation was conducted with the local department of social services. The complaint was determined to be valid.

Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on interviews, it was determined that the staff failed to ensure the care, protection and guidance of all children in care.
Evidence:
On 10/10/19, staff A, C and D were not aware that they had left child A ( 9 years of age) on the playground when they returned to the gym from outside time. Child A was alone on the playground from 4:45 PM to 4:55 PM. Child A's parent discovered child A alone on the playground and escorted the child into the gym and notified the center staff.Plan of Correction: Staff were terminated that were in care of children. New employees have been trained on appropriate supervision.
Standard #: 22VAC40-185-340-F Complaint related: Yes Description: Based on interviews, it was determined that a child under 10 years of age was not always in sight and sound supervision of staff.
Evidence:
On 10/10/19, child A (9 years of age) was left on the school's playground from 4:45 PM until 4:55 Pm at which time,the parent of child A discovered the child on the playground alone.Plan of Correction: Staff involved in not providing supervision were terminated.
Standard #: 22VAC40-191-60-B Complaint related: No Description: Based on a review of six staff files, it was determined that a sworn disclosure statement was not obtained prior to a staff's first day of employment.
Evidence:
Staff B's employment date was 7/22/19 and the sworn disclosure statement was not signed until 10/9/19.Plan of Correction: Will obtain sworn disclosure prior to start date moving forward.
Standard #: 22VAC40-191-60-C-2 Complaint related: No Description: Based on a review of staff files, it was determined that he central registry finding was not obtained within 30 days of employment.
Evidence:
Staff A was hired on 8/5/19, therefore: a central registry report was required by 9/5/19. From 9/5/19 until the staff ended her employment at this corporation ( 10/10/19) there was no central registry on file.Plan of Correction: Will obtain central registry finding within 30 day time period.
Standard #: 63.2(17)-1720.1-B-3 Complaint related: No Description: Based on a review of six staff files, it was determined that one staff did not have an out of state Central Registry Finding background check on file. This check must be requested within 30 days of hire and the status checked on within 45 days of submission of the request.
Evidence:
Staff B was hired on 7/22/19 and there has been no request for the central registry background check for Colorado.Plan of Correction: Will obtain out of state central registry finding background check. Planned to mail off by 10/21/19.
