22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated and completed on 8/26/24. The on-site inspection began at 9:30 am and ended at 10:45 am. The inspector reviewed compliance in the areas listed above.There were 4 children present and 2 caregivers; the point total was 12. The inspector reviewed 4 children?s records and 3 caregiver/household member's records on-site. This inspection included document review, tour of the facility, interviews, and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.036-A
Description: Background checks must be repeated every five years after the original background check.

There was no information located or provided to show the date of the last National Fingerprint check for Person B.

Plan of Correction: Upon locating the background check and if it is more than 5 years old I will redo it.

Standard #: 22.1-289.036-B-1
Description: Sworn disclosure statements are required by the end of the 30th day for new household members.
Person A has been a household member for 5 months and there was no Sworn Disclosure statement on file.

Plan of Correction: This background check will be completed immediately.

Standard #: 22.1-289.036-B-2
Description: National fingerprint checks are required by the end of the 30th day for new household members.

Person A has been a household member for 5 months and there was no Fingerprint check.

Plan of Correction: We will immediately send off for this background check.

Standard #: 8VAC20-800-830-B
Description: Shelter-in-place procedures shall be practiced a minimum of twice a year.

There was no documentation of shelter in place drills for 2023.

Plan of Correction: We will make sure to do 2 shelter in place drills a year.

Standard #: 8VAC20-800-60-B
Description: A child's record shall contain certain information.
Child B's record did not contain emergency contact information, insurance and physician information.

Child C's record did not contain insurance policy number nor authorization from the parents to seek emergency care

Plan of Correction: I will review all children's files to make sure all of the information has been obtained.

Standard #: 8VAC20-800-70-A
Description: Before the child's first day of attendance, parents shall be provided in writing certain information.

1. The parents of child A, B and C were not provided in writing check in and out procedures, payment information, a number to leave a message, termination policies, hours and day s of operation. Child A has been enrolled for 7 months and child B has been enrolled for 4 days and child C has been enrolled for 5 months.

Plan of Correction: I will fill the information out and give a copy to the parents and keep a copy in the children's files.

Standard #: 8VAC20-800-210-A
Description: Repeat Violation:
Caregivers shall obtain a minimum of 16 clock hours of training annually.

Person B has obtained 11 of the 16 training hours for 2023 and Person C has obtained 4 of the 16 training hours for 2023.

Plan of Correction: We will get the additional training.

Standard #: 8VAC20-800-520-A
Description: Cribs shall be provided for children from birth through 12 months of age.

Child A, 9 months of age was sleeping on a cot and not in a crib.
Two infants were present but there was only one crib set up in the home.

Plan of Correction: We will put together another crib and we will make sure children through 12 months of age are sleeping in cribs.
