The center is reminded that the enhanced health and safety requirements during the COVID-19 state of emergency is that groups of children are not combined.
- Comments:

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on 06/15/2020 and concluded on 07/30/2020. A complaint was received by the department regarding allegations of staff-to-child ratios and supervision of children. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.
The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.
Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Standard #: 22VAC40-185-160-C Complaint related: No Description: Based on a review of two staff records and interviews, the center did not ensure that one staff resubmit tuberculosis (TB) test results at least every two years from the date of the first initial screening or testing, or more frequently as recommended by a licensed physician or the local health department.
Evidence: 1) The most recent negative TB screenings in the record for Staff #2 are dated 01/26/2018 and 06/29/2020. 2) During interview, a member of management acknowledged the subsequent TB screening/test for Staff #2 was not completed within the required two year time frame.Plan of Correction: Per the Center: "Ensure TB results are received and placed in file."
Standard #: 22VAC40-185-340-C Complaint related: Yes Description: Based on a review of documentation and interviews, the center did not ensure that during the stated hours of operation, there always shall be on the premises and on field trips when one or more children are present, one staff member who meets the qualifications of a program leader or program director and an immediately available staff member, volunteer or other employee who is at least 16 years of age, with direct means for communication between the two of them.
Evidence: 1) During staff interviews, it was reported that on the morning of 06/08/2020, there was only one staff member scheduled to open the center.
2) The inspector reviewed staff timesheets and the center?s attendance record for 06/08/2020. It was determined that Staff #1 was the only staff member present at the center with 12 children from 6:30am until 7:11am when a second staff member arrived. The children?s ages ranged from 7 months to age 11 and were dropped off between 6:30am and 7:10am.Plan of Correction: Per the Center: "Center will ensure that staffing schedules (backup) will represent and meet licensing requirements."
Standard #: 22VAC40-185-350-C Complaint related: Yes Description: Based on a review of documentation and interviews, the center did not ensure when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group.
Evidence: 1) During staff interviews, it was reported that when the center opens between the times of 6:30am to approximately 7:15am, there are regularly two opening classrooms with ongoing mixed age groups. Staff #1 supervises Group #1 (infants-toddler) and Staff #2 supervises Group #2 (preschool-school age).
2) The inspector reviewed staff timesheets and determined that on the morning of 06/08/2020, Staff #1 was the only staff member at the center between 6:30am to 7:11am when a second staff member arrived.
3) The inspector reviewed the center?s attendance record of 06/08/2020 and determined that Child #1 (10-year-old), Child #2 (11-months-old), Child #3 (5-year-old), and Child #4 (3-year-old) were dropped off between 6:30am to 6:35am. Child #5 (6-year-old) and Child #6 (11-year-old) were dropped off at 6:42am. Six additional children, ages ranging from 7 months to age 6, were dropped off from 6:51am to 7:10am. The 12 children were all in the care of Staff #1. When children are regularly in ongoing mixed aged groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group. The applicable staff to child ratio was one staff member for every four children.Plan of Correction: Per the Center: "Staff will be scheduled to ensure the same age groups are together when received in the morning"
