An unannounced complaint inspection was conducted on 12/05/2023 in response to a complaint received on 11/29/2023 regarding the transportation of children. There was a total of 31 children and 6 staff members present during the inspection. The inspector reviewed video footage, photographs, and interviewed two staff members during the investigation. A total of 5 children?s records, 1 staff record, as well as center policies/procedures were reviewed during the investigation. The inspector arrived at 1:00 pm and departed at 2:30 pm.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.
The information gathered pursuant to an investigation of the complaint supports the allegation and the complaint was determined to be valid.

Standard #: 8VAC20-780-340-A Complaint related: Yes Description: COMPLAINT RELATED
Based on video footage and staff interviews, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection and guidance.
Evidence: Video footage from 11/29/2023 shows Staff 1 putting 5 children (ages 3 years and 4 years) into the backseat of a mid-sized car. Based on Staff 1 statements, the same 5 children were transported to the center for afterschool care on 11/28/2023 and 11/29/2023 in the mid-sized car that was their personal vehicle. Staff 1 stated that one child got into a car seat that was in the backseat of the car and the other four children were also in the back seat buckled into the same seatbelt and not in a child restraint device. The children were transported approximately 3 miles. The Code of Virginia requires that any child, up to age eight, shall be properly secured in a child restraint device of a type which meets the standards adopted by the United States Department of Transportation.
The center did not ensure the care, protection and guidance for the children during their transportation to the center when four preschool age children were transported in a mid-size care without the required child restraint devices.Plan of Correction: We changed our transportation to a minivan with booster seats. All of the required information was placed in the minivan. There are now 2 staff members sent to pick up the children. All new booster seats were purchased and the children are buckled into the seats each day.

Evidence: The cribs in the infant room were not labeled to identify the use by a specific child. Four children were observed sleeping in the unlabeled cribs during the inspection.Plan of Correction: All cribs were labeled with a picture of the child and their name.

Based on staff interviews, the center failed to prepare a document containing local emergency contact information, potential shelters, hospitals, evacuation routes, etc. that pertain to each site frequently visited or of routes frequently driven by center staff for center business such as field trips or pick up or drop off of children to or from schools etc. This document must be kept in vehicles use to transport children to and from the center.
Evidence: Staff 1 and Staff 2 both verified that there was not a document with the required emergency information and information on routes frequently driven in the mid-size car that was used to transport children to the center on 11/28/2023 and 11/29/2023.Plan of Correction: We changed our transportation to a minivan and all of the required information was placed in the minivan.
Standard #: 8VAC20-780-570-B Complaint related: No Description: Based on observations, the center did not ensure that bottles shall not be used while the child is in their designated sleeping location.
Evidence: There was a bottle observed laying in the crib with Child 6. The child was asleep.Plan of Correction: The staff were addressed and the program director is checking daily.

Based on staff interviews, the center failed to ensure that during transportation of children the Virginia state statutes about safety belts and child restraints are followed as required by the Code of Virginia and that the information required by the standard is in the transportation vehicle.
Evidence:
1. Staff 1 verified that on 11/28/2029 and 11/29/2023 they picked up the same 5 children (ages 3 years and 4 years) to transport them to the center for afterschool care in a mid-sized car. Staff 1 stated that four of the children were in the back seat buckled into the same seatbelt and not in a child restraint device. The Code of Virginia requires that any child, up to age eight, shall be properly secured in a child restraint device of a type which meets the standards adopted by the United States Department of Transportation.
2. Staff 1 and Staff 2 both verified that the vehicle used for transportation did not contain the following required information: a 911 or local dial number for police, fire and emergency medical services and the number of the regional poison control center; the center?s name, address and phone number; a list of the names of the children being transported.Plan of Correction: We changed our transportation to a minivan with all new booster seats, updated the first-aid kit and created a new transportation log.

Based on record review and staff interviews, the center failed to ensure that parental permission for transportation and field trips shall be secured before the scheduled activity.
Evidence: The records for Child 1, 2, 3, 4 and 5 did not contain parental permission for transportation. Staff 2 verified that they did not have transportation permission forms.Plan of Correction: Will type up a form to have all parents sign. The forms will be placed in the child's record and in the transportation log.
