22.1 BACKGROUND CHECKS, CODE, CARBON MONOXIDE

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, onsite renewal inspection was initiated and completed on 10/23/2024. The on-site inspection began at 9:50 am and ended at 12:45 pm. The inspector reviewed compliance in the areas listed above. There were 26 children present and 7 staff. The inspector reviewed 5 children?s records and 5 staff records.
The inspection included: document review, tour of the facility, interviews, observations, and measurements.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Standard #: 8VAC20-780-140-A Description: Physical examinations completed by a physician shall be obtained within 30 days after the first day of attendance.
There was no physical examination in the record for Child 2, who has been enrolled for 9 months. There was no physical examination in the record for Child 3, who has been enrolled for 6 weeks.Plan of Correction: The parents were contacted during the inspection.
Standard #: 8VAC20-780-60-A Description: The center shall maintain a separate record for each child enrolled that contains all of the required information.
Child 1 was missing: addresses for emergency contacts; list of those authorized to pick the child up; and the first date of attendance. Child 3 (enrolled 6 weeks) was missing addresses for emergency contacts. Child 5 (enrolled 13 months) was missing information regarding the child?s allergies.Plan of Correction: Will get with the parents to get the information today.
Standard #: 8VAC20-780-80-A Description: For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.
At approximately 10:00 am on 10/23/2024, there were 10 children present in the pre-k class and there were 15 children marked present on the attendance record.Plan of Correction: Will review how to take attendance with the staff.
Standard #: 8VAC20-780-270-A Description: The center shall ensure that areas and equipment, inside and outside, are maintained in a clean, safe and operable condition.
Two rows of back seats on the center?s vans were torn open and the foam stuffing was missing exposing the metal bars of the seat. Two of the seatbelts on the van were broken. The van was used to transport children to school on 10/23/2024 but children were not seated in these areas.Plan of Correction: The van will be removed from use.
Standard #: 8VAC20-780-320-B Description: The water temperature shall not exceed 120 degrees Fahrenheit.
The water temperature from the sink in the Infant Room measured 137 degrees.Plan of Correction: The water heater was recently replaced and the temperature will be turned down.
Standard #: 8VAC20-780-330-B Description: REPEAT VIOLATION
Where playground equipment is provided, there shall be resilient surfacing under equipment with moving parts or a climbing apparatus to create the required fall zones that are free of hazardous obstacles.
The resilient surfacing (pea gravel) under and around the jungle gym on the playground did not have the required amount of resilient surfacing for the fall zone by over 3 inches. The fall zones around the playground equipment in the sandy areas of the playground did not measure the required 6 feet. There were multiple pieces of equipment that were less than 3 feet from a hazardous obstacle.Plan of Correction: Will move equipment around and will remove some pieces from the playground.
Standard #: 8VAC20-780-500-B Description: Diaper disposal systems shall be either foot-operated or used in such a way that neither that staff member?s hand nor the soiled diaper touches the exterior surface of the storage system during disposal.
The diaper disposal system in the Infant Room was broken and the foot pedal no longer worked to open the lid. Staff 6 stated they used their hand to open the lid.Plan of Correction: Was replaced during the inspection.
Standard #: 8VAC20-780-560-F-4 Description: Children three years of age or younger may not be offered foods that are considered to be potential choking hazards.
Children ages 18 months-3 years were served sliced peaches for lunch.Plan of Correction: Will remove from the menu or only serve diced peaches.
