Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An annual subsidy inspection was conducted on 8/13/24 from 10:20 am to 11: 15 am. There was 1 child in care (4 points). The inspector reviewed 1 child's record, 1 caregiver record, emergency drill logs, attendance, trainings and new crib documentation. The child was observed in free play with age appropriate toys.
Information gathered during the inspection determined areas of non-compliance with applicable regulations or law, and violations were documented on the violation notice issued to the vendor.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and staff interview, the vendor did not obtain results of a repeat central registry search (CRS) every five years.
Evidence:
1. The vendor's most recent CRS was dated 4/23/19.
2. The vendor stated that a CRS request was submitted in May 2024 and the results have not come back yet.

Plan of Correction: A follow up will be conducted with the agency and the licensing inspector will be notified as soon as the results have been obtained.
