An unannounced complaint investigation was conducted on-site on May 14, 2024 and June 20, 2024. A complaint was received by the department regarding allegations in the areas of supervision of children. The inspector and cps made observations, reviewed documents and conducted interviews.
Administration was available during the inspections. On May 14, 2024 there were 19 children and 4 staff present in the toddler classroom. On June 20, 2024 there were 13 children and 4 staff present in the toddler classroom. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies and nutrition.
The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint during the course of the investigation can be found on the violation notice.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Standard #: 8VAC20-780-340-A Complaint related: Yes Description: Complaint Related
Based on document review, interview, and observation, the center failed to ensure when staff are supervising children, they shall always ensure their care, protection, and guidance.
Evidence: 1. Incident/accident reports indicate 63 biting incidents occurred in the Toddler room between April 01, 2024 and June 10, 2024. 52 of these bites resulted in injuries that were treated with ice, cold compresses, or other first aid.
2. Administration reported there was a plan in place to deter biting by assigning specific children identified as biters to certain staff to ?break up the biters,? referred to as pocket buddies.
3. Although administration reported that four identified biters in the Toddler classroom had been assigned to specific staff as pocket buddies, three observations of the classroom (one on May 14, 2024 and two on June 20, 2024) revealed that the pocket buddy system is not being implemented. On May 14, 2024, an identified biter was observed climbing into close quarters of an open cabinet with other children without supervision or intervention from staff.Plan of Correction: Center management has partnered with our internal behavioral support team for resources and additional supports for this classroom. Center management will ensure that the new supports and resources are being implemented. Center management will conduct weekly teacher observations to continue to support the teachers. Additionally, center management will share findings of observations with district leader so that further support can be provided.
Standard #: 8VAC20-780-400-A Complaint related: No Description: Based on observation, the center failed to ensure in order to promote the child's physical, intellectual, emotional, and social well-being and growth, staff shall interact with the child and one another to provide needed help, comfort, and support.
Evidence: 1. Observation on June 20, 2024, one toddler was observed screaming and crying for approximately 2 minutes before one of the staff in the room acknowledged and interacted with the toddler.
2. Observation on June 20, 2024, the toddlers were observed standing on a chair and walking from one chair to another and climbing and laying on tables, all of which is over bare floor, and climbing and hiding in open cabinets. Staff did not intervene or interact during these circumstances for several minutes.Plan of Correction: Center management will provide supports to the teachers through teacher observations, KinderCare trainings, and district leader follow up.
Standard #: 8VAC20-780-490-E Complaint related: No Description: Based on observation, the center failed to ensure when any surface has been contaminated with bodily fluids, it shall be cleaned and sanitized.
Evidence: On June 20, 2024, in the toddler room, a child was on the soft play mat with a runny nose, leaving nasal mucus on the play mat. The inspector informed staff, who noted the mat needed to be sanitized, but the staff failed to do so and later another child was observed playing on the soiled mat.Plan of Correction: Center management will retrain teachers by 7/31/2024 on best practices regarding cleaning procedures. Center management will ensure best practices around cleaning are being implemented through teacher observations.
Standard #: 8VAC20-780-500-A Complaint related: No Description: Based on observation, the center failed to ensure that staff shall wash their hands with soap and running water after any contact with bodily fluids, before a diaper change, and before serving beverages.
Evidence: 1. On June 20, 2024, in the toddler classroom, staff was observed to wipe a runny nose of a child. The staff did not wash their hands with soap after wiping the child?s nose.
2. On June 20, 2024, in the toddler classroom, staff was observed not washing their hands prior to one diaper change and prior to handing a child their water cup.Plan of Correction: Center management will retrain teachers by 7/31/2024 on best practices regarding hand washing. Center management will ensure best practices around handwashing are being implemented through teacher observations.

Evidence: On June 20, 2024, in the toddler classroom, staff was observed handing a toddler their cup to drink water while the toddler was walking around.Plan of Correction: Center management will retrain teachers by 7/31/2024 on best practices regarding children eating and drinking. Center management will ensure best practices around eating and drinking are being implemented through teacher observations.
