Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced monitoring inspection was started in the center on May 22, 2024 from 12:55 PM until 3:20 PM and concluded on May 23, 2024. At the time of entrance, 13 children were in care with 4 staff members. The sample size consisted of 5 childrens records and 5 staff records. Children were observed during rest period, eating preparing for and eating snack and playing freely.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-40-J Description: Based on center documentation review and staff interview the licensee did not ensure the injury prevention procedures shall be updated at least annually based on documentation of injuries and a review of the activities and services.

Based on record review and staff interviews, the licensee did not ensure to maintain and keep at the center a separate record for each child enrolled which contained all required information.
Evidence: Staff #5 verified the following missing items from the childrens records.
1.The record for Child #1 did not include the name, home address, employment location or employment phone number for one parent listed.
2. The record for Child #2 did not include home address, employment location or employment phone number for one parent listed.Plan of Correction: This application was done through Brightwheel and the parent filling out the application listed dad only as an Emergency Contact. The only 2 question thats ask are only for the phone number and address of the emergency contact person listed and that is filled out child#1 info was updated. Child #2 info was updated

Based on record review and staff interviews, the licensee did not ensure each staff record contained all required documentation.
Evidence: Staff #5 verified the following missing items from the staff records;
1.Staff #1 and staff #4 did not have a copy of their diploma/transcripts.
2. Staff #2 did not have documentation of two references conducted prior to hire and Staff #3 did not have documentation of the 2nd required reference.Plan of Correction: Staff files will be updated
Standard #: 8VAC20-780-245-J-3 Description: Based on observation and staff interviews, the licensee did not ensure that for any child for whom emergency medications (such as albuterol, glucagon, and epinephrine auto injector) have been prescribed shall always be in the care of a staff member.
Evidence: Child #1, who has an (Epi-Pin) was observed at the center and there was not a person at the center who was trained to administer the emergency medication. Staff #5 confirmed they were the only trained staff working at the center during the inspection and they had left for a lunch break.Plan of Correction: Staff will be train to use Epi-pen
Standard #: 8VAC20-780-245-L Description: Based on observation and staff interviews, the licensee did not ensure there shall always be at least one staff member on duty who has obtained within the last three years instruction in performing the daily health observation of children
Evidence. Staff #5 confirmed they are the only person trained in DHO during the inspection and they were not at the center when the Licensing Inspector arrived.Plan of Correction: Alll staff will be train in Daily health observation.
Standard #: 8VAC20-780-450-A Description: Based on observation and staff interview, the licensee did not ensure cots/mats used by children other than infants during the designated rest period shall have linens consisting of a top cover and a bottom cover or a one-piece covering which is open on three edges.

Standard #: 8VAC20-780-550-P Description: Based on center documentation review and staff interviews, the licensee did not ensure the center shall maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence that includes all required information.

Standard #: 8VAC20-780-560-F Description: Based on observation and staff interviews, the licensee did not ensure to follow the recent, age-appropriate nutritional requirements of the Child and Adult Care Food Program of the United States Department of Agriculture (USDA) when they choose to provide meals and snacks .
Evidence: Potato chips were served as the afternoon snack to the toddlers, two year old and preschool children and therefore the snack did not meet the USDA guidelines. As required two food groups shall be served as snack and food items shall meet the USDA requirements.Plan of Correction: Staff has been train to meet the USDA guidelines

Based on observation and provider interviews, the licensee did not ensure that tables and highchair trays shall be sanitized before and after each use for feeding.
Evidence:
1. Three infants were observed eating snack in highchairs and the three highchair trays were not sanitized before or after use.
2.Toddlers were observed eating snack at a table and it was not sanitized prior to eating.
Sanitized is defined as sprayed with a disinfectant /sanitizing solution and allowed to air dry or wiped down after two minutes.Plan of Correction: All staff was retrained on how to clean and sanitize the tables and high chairs.
