Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Discussed in detail ensuring any vehicle used by the center for the transportation of children shall meet all the requirements (8VAC20-780-580.B).

Discussed and verified with Center Director that classrooms #7, #8, #,9 and #10 and the schooalge children's playground (composite piece and wooden structure) are not being used as the center is addressing maintenance concerns .

Comments:
An unannounced, on-site monitoring inspection was initiated on and completed on July 22, 2024 . The on-site inspection began at 1:20pm and ended at 4:15pm. The inspector reviewed compliance in the areas listed above. CDC: There were 19 children present and 4 staff. The inspector reviewed 5 children?s records and 5 staff records on-site on July 22, 2024. This inspection included a document review, tour of the facility, interviews, measurements and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on July 29, 2024. A POC submitted after this date will not appear on the public website.

Standard #: 8VAC20-780-260-B
Description: Based on documentation review and staff interviews, the licensee did not ensure to obtain an annual approval from the health department.
Evidence: The most recent copy of the health inspection available for review was date 5-19-2023.

Standard #: 8VAC20-780-270-A
Description: Based on observation and staff interviews, the licensee did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe, and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked, or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin.

Evidence: On the playground there were areas that posed as a safety risk to children;
1.The plastic composite playground piece that is closest to the building had an approximate 20 inch broken / cracked section of plastic near the base and broken sharp bolt cover.
2. The wooden playhouse had protruding rusty nails and a loose rusty hinge near the playhouse door and surrounding the base of the playhouse was chipped and peeling paint.

Standard #: 8VAC20-780-280-B
Description: Based on observation and staff interviews, the licensee did not ensure hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence: The following hazardous chemicals were observed stored in an unlocked manner and they were labeled "keep out of reach of children" and at least one other statement "caution", "flammable" and "warning".

1. Hand sanitizer containers were observed on the sign in table, on a shelf in room #4 and in the infant room.
2. In room #4 a spray of bottle of bleach and water was observed sitting on the changing table.

Standard #: 8VAC20-780-560-F-4
Description: Based on documentation review and staff interviews, the licensee did not ensure that when centers choose to provide meals or snacks, that children three years of age or younger may not be offered foods that are considered to be potential choking hazards.

Evidence: Child #6 age, 18 months old was served 1/ 2 of a whole banana and it was not sliced or cut in way that prevents choking.

Standard #: 8VAC20-780-580-B
Description: Based on documentation review and staff interviews, the licensee did not ensure that any vehicle used by the center for the transportation of children shall be insured with at least the minimum limits established by Virginia state statutes.

Evidence: The most recent copy of the insurance for vehicle #3 has an expiration of 4-14-2024. Assistant Center Director confirmed vehicle #3 has transported children 3 times for fieldtrips this summer.
