Comments:
An unannounced inspection was initiated on March 12, 2024, in response to a self-report that was received by the licensing department on March 5, 2024, regarding allegations of forbidden action and behavior guidance. On March 12, 2024, the inspector was on site from approximately 10:00 AM until approximately 11:35 AM. Interviews with staff were completed, observations were made in the center, photos were reviewed, and documentation was reviewed. Additional interviews were conducted offsite.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 8VAC20-780-400-B
Description: Based on staff interviews, the center did not ensure that behavioral guidance shall be constructive in nature, age, and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
Staff 1 stated that when child 1 displays inappropriate behaviors staff will separate the child from others and have grabbed the child by the arms to prevent the child from hurting others. Staff 1 stated that child 1 often displays challenging behaviors such as throwing chairs, tantrums, and hitting others.

Standard #: 8VAC20-780-410-1
Description: Based on interviews, and photos, the center failed to ensure certain actions or threats thereof are forbidden physical punishment, striking a child, roughly handling, or shaking a child, restricting movement through binding, or tying, forcing a child to assume an uncomfortable position, or exercising as punishment.

Evidence:
1. On Friday, March 1, 2024, child 1 (3 years) was sent home early due to the child not feeling well. On March 2, 2024, staff 3 called the child?s mother to follow up. During the call the mother stated that she observed a bruise on child 1?s left ear. Child 1 stated that a teacher hurt the ear. Photos of the child?s ear were sent to staff 3. Child 1 was brought to the center on March 4, 2024 to identify staff, Child 1 identified staff 1 and staff 2 as having hurt the ear.
During interviews with staff and a representative of a local agency, staff 2 stated that on Thursday February 29, 2024, staff 1 brought child 1 to the toddler classroom because child 1 was behaving inappropriately. Staff 2 stated that when child 1 behaves inappropriately, staff will usually bring the child to her classroom because she?s able to calm the child down. Staff 2 stated that when staff 1 brought child 1 to the classroom, staff 2 was holding the child by the left ear as staff 2 was trying to prevent child 1 from scratching her. Staff 1 admitted to pulling child 1?s ear in interviews with center staff and the local agency representative.
