Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
The violation notice was amended based on the determination of a first step review conducted on 10/07/2024.
An unannounced inspection was initiated on 08/22/2024 and completed on 08/22/2024 in response to a complaint received by the licensing office on 08/21/2024 relating to allegations of noncompliance of staff-to-children ratios. The inspector reviewed three staff records on-site. This inspection included documentation review, tour of the facilities, observations, and interviews.
The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 09/10/2024. A POC submitted after this date will not appear on the public website.

Description: (REPEAT VIOLATION) Based on observation and interview, the center failed to ensure the staff-to-children ratio for birth to 16 months was one staff to four children whenever children are in care.

Evidence:

In the infant classroom two teachers were observed with nine infants, youngest age four months, for approximately 20 minutes. Two staff indicated there have been as many as 20 children with three staff in the mornings, when the required staff to children ratio was 1 :4 due to mixed age groups.

Plan of Correction: Signs were placed on classrooms stating the ratio for the room. They are also requesting parents to wait to leave until the ratio is being met. Each classroom has been outfitted with an emergency bell that rings directly to all office staff to notify them that assistance is needed. Office staff will be monitoring and staff will be instructed properly on how to keep the ratio maintained.

Evidence:

In the early 2's classroom one staff member was observed with ten children. The youngest child was two.

Plan of Correction: Signs were placed on classrooms stating the ratio for the room. They are also requesting parents to wait to leave until the ratio is being met. Each classroom has been outfitted with an emergency bell that rings directly to all office staff to notify them that assistance is needed. Office staff will be monitoring opening everyday to ensure that staff are instructed on how to properly maintain the ratio and make sure ratio is being maintained.
