Comments:

An investigation was initiated on 12/10/19 in response to a self reported incident regarding a child being left unsupervised by a staff person on that same date. An unannounced on-site inspection was conducted on 1/2/20 and interviews with staff were conducted. Documentation and video footage related to the incident were reviewed and additional collateral interviews were also conducted. The investigation was concluded on 1/31/20. Based on the information gathered during the investigation, the incident is found to be valid. Three violations in the areas of administration and staffing and supervision are identified on the violation notice and were discussed with the center director during the exit interview on 2/11/20.

Standard #:	22VAC40-185-40-E
Description:	Based on interviews, video footage and a review of the center's policies, the center failed to ensure that the operational responsibilities of the licensee shall ensure that the center's services are maintained in compliance with the center's own policies and procedures that are required by these standards. Evidence: The center failed to follow their written policy regarding supervision of children as demonstrated by the following incident: 1. The center's policy for supervision of children states "Employees must not take actions that put children at risk or in dangerous situations. This includes, but is not limited to, leaving a child unsupervised." The center's policy also states "All enrolled children must be supervised at all times." 2. On 12/10/19, child 1, age 7 years, was dropped off of the center bus by staff 1 and left outside of a local public elementary school unsupervised for approximately 5 minutes. 3. Staff 2, center director, confirmed that staff 1 did not follow the center's policy for supervision of children.
Plan of Correction:	The center responded with the following: All staff will be retrained on KCE policies on supervision and transportation policies. Management will continue to monitor and work with the school age bus routine to ensure we are complying with all regulations. Additional supervision checks will be completed on the bus CSR to ensure that children have been safely transported to and from school. Management will complete observation of transportation routines with any new drivers and make any adjustments necessary to support safety of children. Administrative actions will be taken if any staff continue to not follow our supervision standards.
Standard #:	22VAC40-185-340-A
Description:	Based on interviews and a review of video footage, it was determined that the center failed to ensure that when staff are supervising children, they shall always ensure their care and protection. Evidence: 1. On 12/10/19, staff 1 was transporting children to a local public elementary school and let child 1, age 7 years, off the bus prior to the school opening. Staff 1 left the premises and did not know if child 1 entered the school. a. Video footage provided by the local public school shows child 1 getting off the center bus at 8:15am. The bus was twelfth in line for drop-off and approximately 600 feet from the designated drop-off location at the front door of the school when child 1 was let off the bus. b. The video shows the center bus pulling away and driving out of the school parking lot as soon as child 1 gets off of the bus and without ensuring that child 1 arrives safely inside the school. By 8:16am, the center bus is completely out of sight of child 1, who is walking alone alongside moving cars in the drop-off area. 2. Child 1 reported to her parents that staff 1 told her to get off of the bus but she did not want to do so. Child 1 stated that staff 1 then told her that if she did not get off she would report her to the office and she would get in trouble. Child 1 told her parents that she was scared and did not want to get in trouble so she got off the bus.
Plan of Correction:	The center responded with the following: Management made the decision to no longer allow certain staff to be responsible for transportation of children. Any new incoming staff or current staff filling in will go through extensive training on transportation and safety expectations. Management will use Professional Development Day to have a discussion around supervision with all staff members. District Leader will periodically call public schools to receive feedback on transportation drop off/pick up.

Description:	Based on interview and a review of video footage, the center failed to ensure that children under 10 years of age always shall be within sight and sound supervision of staff. Evidence: 1. The center self-reported that on 12/10/19, child 1, age 7 years, was dropped off in the parking lot of a local public elementary school by staff 1 without any staff supervision. 2. Video footage obtained by the local elementary school shows child 1 being let off the center bus alone at 8:15am and being let in the school by school staff at 8:20am when the school opened. Child 1 was out of sight and sound supervision of center staff for approximately five minutes.
Plan of Correction:	The center responded with the following: Teacher and center management will review the licensing standards regarding supervision within sight and sound. Additional resources will be given to staff to support our policies on supervision in older age groups. Management will continue to have conversations with staff around the importance of compliance and supervision safety. All new staff coming in will observe supervision and transition activities in driver training prior to being in ratio.
