Technical Assistance:
* Discussion that effective January 1, 2025, VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/. Resources are now available for providers on the "What's New" webpage on the childcare.virginia.gov website at https://www.childcare.virginia.gov/providers/what-s-new. There are two new resources available on the What?s New page to help with the potable water lead testing law: FAQs updated August 2024, with 11 new FAQs added; Potable Water Testing Plan eTracker for Child Care Programs, an optional template for providers to create their testing plan for submission to VDH.

* Discussion that the Code of Virginia, ? 22.1-289.035 A, requires that all background check components be completed for all applicants for employment, employees, applicants to serve as volunteers, and volunteers prior to employment or beginning to serve as a volunteer and every five years thereafter. VDOE had previously required that both Virginia and out-of-state child abuse and neglect checks be requested within 30 days of employment. Instead, these requests must be submitted prior to the date of employment. This change allows prospective employees and volunteers to be provisionally hired upon receipt of a satisfactory fingerprint check signified by written documentation from the Office of Background Investigations stating that the individual is eligible for hire. Provisionally hired employees and volunteers must be in the line of sight of at least one other staff member who has a complete and satisfactory background check and must not be left alone with children until all components of the background checks required in? 22.1-289.035 of the Code of Virginia are complete. New applicants for employment and volunteering hired on or after July 1, 2024, may be provisionally hired if the applicant has received qualifying results on a fingerprint-based background check through the Central Criminal Records Exchange or the Federal Bureau of Investigation. Current employees must continue to meet the requirements set out in ? 22.1-289.035 of the Code. Previous background check requirements apply to all applicants and volunteers hired prior to July 1, 2024.

* Discussion that the term ?resided? or lived in any other state is not limited to only a legal residence. The regulation, Background Checks for Child Day Programs and Family Day Systems in 8 VAC 20-770 states that ?living in? means to reside in a place for an extended or permanent period of time. The Code of Virginia 22.1-289.035 B 4. and 22.1-289.036 states that all applicants for employment are required to obtain the out-of-state background checks for any state the applicant has lived in the past five years. This would include a person living in another state due to a military assignment or to attend school for an extended period of time.

* Discussion that effective 11/15/23, to be authorized to give seizure rescue nasal spray to a child in your care, a provider must hold a current MAT Certificate AND a specialized certificate.

Comments:
An unannounced, on-site monitoring inspection was initiated on 09/06/2024 and completed on 09/06/2024. The on-site inspection began at 9:30 am and ended at 1 pm. The inspector reviewed compliance in the areas listed above. There were (119) children present and (30) staff. The inspector reviewed (5) children?s records and (13) staff records [on-site] on 09/06/2024. This inspection included:

? document review, policies and procedures, emergency drill logs, medication administration logs, authorization forms,
? tour of the facility,
? interviews,

Information gathered during the inspection determined non-compliance with an applicable standard & code, and the violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on review, 1 of 13 staff files reviewed indicated that an out-of-state CPS check was not requested prior to employment.

Evidence -
1. On the date of inspection (09/06/24), the start date for Staff #10 was listed as 08/06/2024.
2. The Sworn Disclosure Statement (dated - 06/24/2024) indicated that Staff #10 resided in another state within the past 5 years.
3. An out-of-state CPS check from this state was not requested prior to their start date according to administrative staff.

Plan of Correction: A CPS check was requested. A copy of this request was also sent to the LI.

Standard #: 8VAC20-780-280-B
Description: Based on observation, cleaning materials were not kept in a locked place using a safe locking method that prevents access by children.

Evidence -
1. On the date of inspection (09/06/2024), a cabinet within room 112, was left unlock.
2. When opened, cleaning supplies (not in use) were observed being stored inside.

Plan of Correction: Corrected on the date of inspection.
